Complex & High Value Transactions

Residential Property

Head of Department, Gemma Bath joined Girlings from a firm based in Richmond-upon-Thames, Weybridge and Wimbledon. During her time of practice in Surrey, she has had the privilege of working on the acquisition and disposal of many high net worth properties (including the acquisition of a property in central London purchased for £10,500,000.00).

Gemma has generated a very loyal client base with much of her current work coming from repeat business and referrals from existing clients or estate agents who have recommend her service.

Our team has a strong track record of positive feedback from clients and a reputation for keeping clients and work referrers up to speed at all stages of the transaction. Our emphasis is always on trying to solve problems that arise in a transaction rather than just advising it cannot go ahead.

We enjoy getting to know the agents we work alongside, which means we are able to then ask for meaningful assistance in chasing a specific element of a deal allowing for the parties to work seamlessly together. We have always found working in this manner to be of significant benefit to all parties in the chain and this approach can often mean that a transaction is able to progress far more expediently.

The team has also received lots of positive feedback for their ability to progress matters swiftly. We take particular care over the timings of the transaction and try to identify any areas which are likely to cause delays as quickly as possible. For example, we will review a lease at the start of the transaction to see if there are any obvious defects which will need addressing by way of a Deed of Variation. We can then put the request for the Deed of Variation in motion at the start of the transaction so that this does cause delay at a critical later stage. We find simple steps like this make a huge practical difference.

Farm and rural land

If you are buying or selling a farm you will need skilled advice to ensure that your particular transaction proceeds as smoothly as possible. We have wide-ranging experience in such transactions and provide a broad and cost competitive service.

Selling a farm

There are many factors to take into account when selling a farm and it is important to ensure that all aspects of the sale are considered prior to marketing. We can help with:

  • Preparing a full and comprehensive legal pack for the sale
  • Boundary considerations for the sale brochure
  • Planning documentation
  • Helping with option or overage rights and rights of ‘first refusal’
  • Access to crops or storage needed after the sale has completed
  • Ensuring Land not being sold retains appropriate rights of access.

Buying a farm

There are many elements involved in purchasing a farm beyond those which would appear in a regular sale/purchase transaction and require careful attention. The following list of issues to consider is by no means exhaustive:

  • Boundary issues
  • Sporting rights
  • Access to the public highway
  • Private water supply issues
  • Planning issues
  • Tax considerations
  • Employment issues
  • Basic Payment Scheme entitlements and their transfer
  • Milk quota
  • ELS & HLS and other grant schemes
  • Early entry for crop cultivation or holdover by the Seller for existing crops.
