Landlord & Tenant

Dispute Resolution for Individuals

Short term tenancy agreements and long leaseholds are a common occurrence. Whatever the nature of your tenancy agreement both landlords and tenants have a duty to meet the terms set out in the tenancy, whether it is for six months or a registered long lease.

Unfortunately disputes between landlords and their tenants are not uncommon and are on the increase. If you are a landlord and have tried to resolve a dispute directly with your tenant and failed, now is the time to seek legal advice and assistance.

If you are a tenant in dispute with your landlord we can also help.

Whether your matter is contentious or non-contentious our objective is always to explain the applicable principles and the available options so that an informed decision can be made as to the best course of action necessary.

Short Term Tenancy Agreement

In relation to short term agreements (more often than not an Assured Shorthold Tenancy) we are able to provide both landlords and tenants with advice and assistance centred on rent arrears, repairs, funding deposits and anti-social behaviour. Disputes often arise at the end of a tenancy for example when landlords express concerns over the state and condition of the property. Landlords and tenants should always seek advice in relation to termination arrangements to ensure that proper statutory procedures are and have been followed.

Long Leasehold

In the case of long leasehold arrangements disputes often arise with landlords about service charge demands, management of the building or responsibility for major repairs. Whatever the nature of the matter we are here to help.

In addition we advise and act in relation to tenant rights to extend long leases of flats or houses and also the acquisition of the freehold of the property.

Common landlord and tenant issues

We have experience in advising landlords and tenants on a wide range of matters including:

  • Illegal eviction / possession claims
  • Rent arrears
  • Disrepair and dilapidations
  • Trespass
  • Service charge disputes / maintenance issues
  • Enfranchisement claims – lease extension and collective freehold acquisition.

If you are a landlord or tenant and have tried to resolve a dispute directly with your tenant or landlord and failed, now is the time to seek legal advice and assistance.
