Contesting a Will

Lee Quickenden, Associate and Fellow of CILEx in the Girlings Solicitors’ Dispute Resolution Team, outlines some of the issues around contesting a will.

While there are many myths around entitlement to potential gifts or assets from someone else’s will, a person is largely free to leave their assets to whoever they choose – subject to certain requirements under Common and Statute Law.

However, challenges to wills are becoming increasingly common and may, for example, question the capacity of the person who made the will or cite an undue influence over them.

During what can often be an emotionally turbulent time for clients, Girlings Solicitors can help both challenge and defend a challenge to a will by getting to the heart of the matter, sifting through the facts, and identifying common ground.

Girlings Solicitors also promote mediation and alternative dispute resolution processes as a frequently cheaper and more effective way to reach a resolution for all parties involved.
