No Fault Divorce

Last week over 150 Resolution members gathered in Parliament to call for ‘No Fault Divorce’. 

Resolution represents family justice professionals including the Family Solicitors at Girlings Solicitors who are committed to supporting couples to achieve a solution to family disputes in a non-confrontational way. Currently parties have to wait 2 years post separation if they want to proceed with divorce on a no fault basis.  This means that to issue divorce proceedings before 2 years one party has to “blame” the other party and cite either adultery, if applicable or unreasonable behaviour if they do not want to wait 2 years.  After the parties have separated for 2 years they can divorce on the basis of 2 years' separation with consent.

It is hoped that the Government will face pressure to introduce a new system whereby parties can issue divorce proceedings prior to being separated for 2 years and not have to blame the other party. The blaming of one party often creates hostility and unnecessary arguments at times when often relations are already strained and difficult.
