Commercial Property Team Advises Developer Client on Option Agreements

Senior Associate Solicitor, Amy Husk is acting for developer clients in respect of several option agreements on land in East Kent. Option agreements on land ensure that the developer has the certainty of acquiring the land once planning has been obtained if they wish, but does not oblige them to do so.

Option agreements require an experienced lawyer with an eye for detail to carry out thorough investigations into the land before the client enters into the agreement. These investigations protect the developer from spending fairly significant sums on the planning process only to find out later that a commercial lender will not fund the project because there are, for example, title issues with the land. They also alert the developer to any other potential issues with the land that might arise in the future.
