Notary Services

Many transactions with a foreign element require a Notary Public. Whilst notaries are often solicitors, it is a separate profession and regulated by the faculty office of the Archbishop of Canterbury rather than the Solicitors Regulatory Authority.

Girlings has an arrangement with two notaries. Whilst they both conduct their notarial practice independently from Girlings, they are able to see clients at our offices or at your own premises when required. They are both members of the Notaries Society of England and Wales and provide a full range of Notary Public Services to both Private and Corporate Clients.

Lindsay Sharp, a Solicitor within our Commercial Department, is a Notary Public and works predominantly from our Ashford office at Stourside Place.

Common tasks undertaken by a Notary for Individuals include:
 
  • Attesting the signature and execution of documents
  • Authenticating the execution of documents
  • Authenticating the signing of an acknowledgment for use in the United States of America
  • Certifying copies of academic qualifications
  • Certifying copies of passports and other documents
  • Attesting powers of attorney and other documents for use in countries throughout the world
  • Sponsorship documents
  • Documents for foreign adoption applications
  • Affidavits confirming freedom to marry (often required to marry abroad)
  • Administering oaths, affidavits and statutory declarations for foreign jurisdictions
  • Taking evidence in England and Wales (depositions) for use in foreign courts
  • Applying for legalisation of documents at the Foreign and Commonwealth Office (sometimes called 'obtaining an apostille') and for legalisation from the relevant embassy

The preparation of documentation for Notarial action is formal and prior preparation of documents or draft documents may be required.
